Our companies operate a combined fleet of 10 trucks and trailers, each with its own DOT number and separate insurance policies for general liability and cargo insurance. We need legal guidance on the following:
Intercompany Agreements:
Drafting and reviewing agreements that define operational relationships between our two companies.
Ensuring these agreements cover insurance liabilities and responsibilities, especially when trucks from one company operate under the authority of the other.
Insurance Matters:
Advising on adding each company as an additional insured on the other’s insurance policies.
Ensuring compliance with FMCSA regulations and minimizing legal and financial risks.
Claims Handling:
Guidance on managing claims that may arise when a truck from one company, operating under the authority of the other, is involved in an incident.
Structuring agreements to specify primary and secondary insurance coverage in such events.
Requirements:
Proven experience in transportation law, particularly in the trucking industry.
Familiarity with FMCSA regulations and commercial truck insurance.
Strong background in drafting and reviewing legal agreements related to transportation and logistics.
Ability to provide clear, actionable legal advice to ensure compliance and minimize liability.
Preferred Qualifications:
Experience with intercompany agreements and insurance endorsements in the transportation sector.
Excellent communication skills and attention to detail.
Availability for ongoing consultation as needed.
Project Scope:
Initial consultation to understand our specific needs and review current agreements and insurance policies.
Drafting and/or revising intercompany agreements to include necessary legal and insurance provisions.
Ongoing legal support for any related issues or claims that may arise.
