Prepare a motion to strike an appellate Opening Brief, and then an Answering Brief if necessary – Upwork


I have a case before the Court of Appeals right now where the Opening Brief was filed by a self-represented litigant. The brief is an absolute mess. So, the first step will be to file a motion to strike the opening brief, as well as a motion to clarify the issues on appeal as the Opening Brief lacks clarity as to what issues exactly are identified as the error made by the lower court. Should the COA not strike the Opening Brief and dismiss the appeal, I will then need an Answering Brief. This is a fairly tight timeline, and I will need the motion to strike ready in the next 2 weeks.

I will be able to provide relevant cases, so access to a legal database is not necessary. I will also be able to provide forms/templates that can be used. I can even provide similar motions/briefs that have been filed in this matter as this is not the first time this person has filed a frivolous appeal.

However, you must have experience with higher level legal writing. Appellate experience is preferred, but appropriate trial court experience such as complex motions to dismiss or a motion for summary judgement may be sufficient. A writing sample would be very helpful; providing a relevant writing sample would absolutely move your application to the top.
